醫院暴力事件頻傳　立院修法加害人須負刑責

【蔡明樺／台北報導】醫院暴力層出不窮，毆打醫事人員恐面臨刑責！立院社福及衛環委員會今審查《醫療法》修正草案，為保障患者就醫安全，通過任何人在醫院內強暴、脅迫或恐嚇醫事人員者，若破壞醫療設備損及患者健康，將可處3年以下有期徒刑；若直接對醫事人員施暴、言語恐嚇，刑責加重為5年以下有期徒刑或50萬元以下罰金，若醫事人員因此受重傷，最重可處10年以下有期徒刑，因朝野立委對制裁醫院暴力有高度共識，立院本會期有機會三讀通過《醫療法》修正草案。

衛福部醫事司司長李偉強指，今日審查通過《醫療法》條文，雖未將「非告訴乃論」（公訴罪）入法，但只要醫院暴力事件發生，員警到場處理認為已涉及刑事責任者，就可移送地檢署偵辦，且無論被害人是否提告，檢察官都可視暴力情節決定是否起訴，已有公訴罪內涵。李偉強舉林口長庚醫院護理師遭呼巴掌，及安南醫院護理師遭言語威脅等事件為例，將來《醫療法》三讀後，加害人都可能因此面臨刑事責任。
